Privacy Advocates Sue OpenAI Over Data Misinformation

Following successful legal actions against Google, Meta, and Apple for data privacy violations, the digital rights organization NOYB has set its sights on OpenAI, the creator of ChatGPT. NOYB argues that ChatGPT fails to comply with the General Data Protection Regulation (GDPR) and is seeking fines against the company.

European Authorities Investigate, But Progress Stalls

While European data protection agencies, including Italy and the European Data Protection Board (EDPB), have been investigating ChatGPT since April 2023, no concrete decisions have been made. This lack of action prompted NOYB’s lawsuit.

Key Issues: Fake Data and Lack of Transparency

NOYB’s primary concern centers around ChatGPT’s tendency to fabricate data about individuals, which violates Article 5 of the GDPR prohibiting personal data misinformation. Additionally, the GDPR mandates user control over their data, including the right to rectification. However, NOYB contends that OpenAI lacks transparency regarding data sources and doesn’t offer users the ability to rectify inaccurate information.
